BEFORE: ENGEL, KEITH and MERRITT, Circuit Judges The petitioner appeals from an order entered on March 1, 1979, by the district court dismissing petitioner's habeas corpus petition. The petition alleged that the sentencing court sentenced petitioner to the Medical Center for Federal Prisoners for study and evaluations after which it would review these reports and enter a final sentence. The petition alleges this review never occurred. This matter now comes before the Court on petitioner's motion for appointment of counsel. The motion for appointment of counsel is denied. Upon examination of the record on appeal pursuant to Rule 9(a), Rules of the Sixth Circuit, we conclude that the questions on which the decision of this cause depends are so frivolous and without merit as not to require further argument.
